These Terms and Conditions apply to consumer bookings made with Eloi Merle (“we”, “us”, “our”). Please read them carefully before booking.

Definitions

Guest” means the person making the booking and all persons included in the booking.

Stay” means the accommodation services booked for specific dates at Eloi Merle.

Booking Confirmation” means our written confirmation sent by email.

Bookings and Contract Formation

A booking request becomes binding only when:

  1. we have received the required payment; and
  2. we have issued a Booking Confirmation by email.

If we do not confirm your booking, any sums paid will be refunded.

Your Stay (Check-in / Check-out)

  • Check-in is from 4:00p.m. to 6:00p.m. on the arrival date.
  • Check-out is by 10:00a.m. on the departure date.
  • Late arrival must be agreed in advance. We may not be able to accommodate arrivals outside the stated check-in window. Please contact us before your journey if you expect to arrive after 6:00p.m.

Unless expressly stated in your Booking Confirmation, your Stay includes:

  • accommodation in a private room/gîte with en-suite shower room (shower, wash basin, toilet); and
  • breakfast, only if you have booked a “B&B” rate/room.

Your Stay does not include: travel costs, insurance, gratuities, or personal expenditure.

Documentation (Passport / Visa)

You are responsible for ensuring you have valid travel documentation (passport, visa, etc.). If you are refused entry to France/Europe for any reason, this will be treated as a Guest cancellation and our cancellation terms will apply.

Prices and Payments

Currency: Prices are in Euros (€) unless stated otherwise.

Standard bookings: 50% of the total cost of your Stay is required at the time of booking. The remaining 50% is due 60 days before your arrival.

Large / exclusive bookings (whole-property block bookings): we may accept a deposit, with the balance due by the date stated in your Booking Confirmation.

Payment methods: bank transfer or credit card. We are a cashless business.

A €200 hold will be placed on your card at the time of booking to cover incidental costs and/or damages during your Stay. If your incidental costs or damages exceed this amount, you agree that the Company may charge those additional amounts to your card.

If you request to pay in a non-Euro currency, this must be agreed in advance. Any exchange rate applied will be set by our bank/payment provider at the time(s) of payment.

The Guest confirms they are authorised to use the payment method provided.

Credit Card Payments

Card payments may be processed by us or our payment agents/providers.

Nothing in these Terms limits or removes your statutory rights, including in cases of fraud or unauthorised payment.

Where a deposit is taken for a large/exclusive booking, you authorise us to charge the remaining balance to the same card used for the deposit on the due date stated in your Booking Confirmation, subject to applicable payment security requirements (including PSD2 / Strong Customer Authentication where required). If the charge cannot be completed, you remain responsible for paying the outstanding balance by another method.

Insurance

We strongly recommend that you take out comprehensive travel insurance, including cover for cancellation, illness, accident, and personal belongings. These Terms do not exclude or limit our liability where such limitation is prohibited by law.

Cancellations by the Guest

How to cancel

Cancellations must be sent by email to info@eloimerle.com. Cancellation is effective on the date and time we receive your email. You are responsible for ensuring your cancellation email has been received.

Cancellation fees and refunds

If you cancel after booking, the following cancellation fees apply:

  1. More than 60 days before arrival: the deposit paid (50%) will be forfeited.
  2. Fewer than 60 days before arrival: no refund.

No-show and early departure

  1. If you do not arrive (no-show), this will be treated as a cancellation and no refund will be due.
  2. If you cancel after the Stay has started (from the scheduled check-in time on the arrival date), no refund will be due.
  3. If you depart early, no refund will be due for unused nights.

Re-letting of cancelled dates

If we are able to re-let all or part of the cancelled dates, we may (but are not obliged to) refund additional sums, less any reasonable costs incurred as a result of your cancellation (including payment processing fees and administrative costs).

Changes Requested by the Guest

Date changes are subject to availability and must be requested in writing by email.

  • If the new dates are cheaper than your original booking, the price paid remains the same (no refund of the difference).
  • If the new dates are more expensive than your original booking, you must pay the price difference before the change is confirmed.
  • We may charge an administration fee of €100 per booking change request. This fee will be confirmed to you before the change is processed.
  • If we cannot accommodate the requested change, your booking remains on the original dates and the cancellation policy will apply if you choose to cancel.

Cancellations by the Company

If we cancel your Stay for reasons other than force majeure, we will refund all sums paid for the Stay. We are not responsible for additional costs you may incur (such as travel costs) unless required by applicable law. Nothing in these Terms limits or excludes our liability where such limitation is prohibited by law.

Right of Withdrawal

As the Stay is accommodation provided on specific dates, the statutory right of withdrawal does not apply.

Guest Warranties and Responsibilities

The Guest confirms that:

  1. they have authority to enter into this contract for all persons included in the booking;
  2. all Guests will comply with house rules and safety instructions; and
  3. all information provided at booking is accurate.

Guest Behaviour

We will not tolerate abusive, threatening, discriminatory, or inappropriate behaviour towards staff or other guests. We may refuse entry or require any Guest to leave immediately (without refund) if their behaviour:

  1. endangers the safety, comfort, or wellbeing of others;
  2.  risks damage to the property; or
  3. involves illegal substances or unlawful activity.

Where possible, we will act proportionately and reasonably in making such decisions.

Property Damage and Indemnity

Guests are responsible for any damage caused by them to the property, fixtures, fittings, or contents. We may charge reasonable repair/replacement costs and any associated professional fees (e.g. locksmith, specialist cleaning) where damage occurs. Guests are responsible for damage or loss caused to third parties by their actions.

Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  1. death or personal injury caused by negligence;
  2. fraud or fraudulent misrepresentation; or
  3. any other liability which cannot be limited under French law.

Subject to this clause, we are not liable for indirect or consequential losses. Subject to this clause, our total liability to you in connection with your Stay shall not exceed the total price paid for the Stay.

Reservations of Rights

We may make minor changes to the accommodation or services for operational reasons. We may refuse a booking or cancel a Stay where required for safety, legal, or operational reasons. Where we cancel, the clause “Cancellations by the Company” applies.

Accessibility and Health

Eloi Merle is a historic building and may not be suitable for Guests with restricted mobility. Guests with disabilities, reduced mobility, or significant health conditions should notify us at the time of booking so we can confirm whether the Stay is suitable. We may decline a booking where we reasonably believe we cannot safely meet a Guest’s needs.

Third-Party Services

If we assist with arranging third-party services (taxis, tours, tastings, etc.), any contract for those services is between you and the third-party supplier. We are not responsible for the supplier’s acts or omissions.

Smoking Policy

Smoking is not permitted anywhere at Eloi Merle. If a Guest smokes on the premises, we may require them to leave and may charge for any additional cleaning or damage (€250 additional cleaning fee per room).

Children

Eloi Merle is an adults-only establishment. We do not accept guests under the age of 18 years.

Pets

The owners have a dog on site. No other pets are permitted.

Photography and Video

We may take photographs or video on the premises for marketing purposes. If you do not wish to appear in identifiable form, please tell us at the time images are captured and we will take reasonable steps to avoid using recognisable images of you. We will always discuss this with you at the time.

Force Majeure

We are not liable for failure to perform, or delays, due to events outside our reasonable control (force majeure), including (for example) natural disasters, fire, flood, war, terrorism, pandemics, government restrictions, and severe weather. If force majeure prevents the Stay from taking place, we will contact you to discuss appropriate solutions, which may include rescheduling where possible or refunding sums where required by law.

Severabillity

If any provision of these Terms is held to be invalid or unenforceable, the remainder will continue in full force and effect.

Governing Law and Jurisdictions

These Terms are governed by French law. Any dispute will be subject to the jurisdiction of the competent courts in France.

Updates to These Terms

We may update these Terms from time to time. The version applicable to your booking is the version provided at the time of booking/Booking Confirmation.
